Royalty and the Law

By Derek Bennet & Michael Wood

News of Andrew Mountbatten-Winsor's arrest due to his links to Jeffrey Epstein, who died in prison accused of paedophilia and other related crimes, has potentially done great damage to our Monarchy. With the loss of our wonderful Queen Elizabeth II on the 8th September 2022, who's reign spanned 70 years and 214 days, made her not just a successful Monarch, but the longest reigning of all our history.

She saw massive changes during that span of years from 1952. During her long reign Britain rebuilt and become a successful nation after the Second World War, she also oversaw the insanity of the UK being frogmarched into the European Community in 1973 by her Prime Minister, Ted Heath, which stole our sovereignty and right to govern ourselves, then on to our eventual escape in 2020, two years before the end of her life.

Britain has a long line of Monarchs going back centuries, we have an extensive list of Kings and Queens going through history through to the present day with King Charles III. That history is fascinating to read, it is a history of great importance and of interest which we forget about and lose at our peril. Sadly, due to the antics of those two, Prince Harry and the then Prince Andrew, not to forget the left wing brainwashing currently taking place in schools. Sadly, Children are now busily engaged in the folly of being taught the importance of woke issues above all else, rather than being educated on our long history and constitutional importance of our Monarchy, as those of us who are older will remember. Today, our Monarchy faces a real test to survive the republican onslaught which is all too happily being promoted by the BBC and other left leaning media.

King Charles, who came to the throne late in life, is now living with cancer and, considering his health, has been doing a remarkable job. Princess Catherine has also gone through the same health trauma leaving the Prince of Wales trying to undertake his Royal duties and care for his family, life has not been easy for our leading Royals. We have to be thankful for Princes Anne who works her socks off for the 'Firm'. Seeing this and not applying the principle of: 'you don't kick a man when he's down, the left wing republicans have gone on the attack, claiming the Monarchy is outdated and should be abolished. Andrew due to his foolishness, has provided them with a great deal of ammunition to attack our Monarchy and their constant calls to turn Britain into a tin-pot republic. I personally think they do not realise the full impact of what they are calling for. Just like the days of Oliver Cromwell, after the execution of King Charles I, if we abolish the Monarchy it will not take long before the country will be clambering for a return of a Monarch after trying to be a republic.

In reality, unlike the Monarchy that remains apart from politics, a President would have great power and dependent on who gets elected to that position, will, no doubt, split and divide the nation, unlike our Monarch's who hold the nation together through thick and thin. With Labour and the Conservative parties currently plummeting in the polls, could you imagine the despair and angst and the wringing of hands from all the Liberals and lefties if the people elected Nigel Farage as the first President of the United Kingdom. In such a case it would almost be worth having a republic to see all the socialist weeping in the streets at their own folly of campaigning to get rid of the Monarchy. Obviously, on the other hand, I too would be weeping in the street if we were saddled with a President Tony Blair who did immense damage to the nation during his wrecking spree as our Prime Minister.

The essential thing about our Monarchy, which is seldom mentioned, it is an integral part of our nation's constitution. People often say we do not have a written constitution, but it is more complex than that, parts are written and parts laid down in layers of law and legal presidents going back over centuries, beginning with Magna Carta, the Great Charter of England, going through to the 1689 Bill of Rights and on to the present day. Our Monarchs have overseen these developments over the centuries and, despite a few rogues amongst them, they have ensured Britain has developed into a stable democracy seeing us through wars and other turmoil over the centuries and decades - we lose our Monarchy at our peril. God save our King.

Common Law developed from the laws brought to England by the Anglo-Saxons. At its centre has always been the simple rule that no one is above the law. King Æthelred II was exiled and allowed back only after promising to rule according to law. Charles I lost his head for refusing tp do so. The monarchy has become the defender of the people and that is its huge value and benefit. The extraordinary antics of Donald Trump in ignoring the US Supreme Court are a warning to anyone who wants a Presidential system.

We also must thank the Anglo-Saxons for Juries, Bail and the presumption of innocence. Only after a person is found guilty by a trial in court are they in fact guilty. Now we have trial by media. How can anyone have a fair trial when they are prejudged? When treatment is not even-handed? Mountbatten–Windsor was arrested. The reason given was so that his homes could be searched. He has not been charged. Mandelson's homes were searched, but he was not arrested. Why not? Why the difference in treatment?

Mandelson has a history of dodgy behaviour and an amazing ability to bounce back from each disgrace. Both men in this saga have behaved foolishly. Whether they were criminal is another matter. That should be a matter for due process, not rabid media speculation. The online Perp Walk may satisfy those who thirst for lynch law. It has nothing to do with justice. Whatever Mountbatten–Windsor has, or has not, done is for a court to decide if there is evidence to charge and try him. It is not the responsibility of his relatives. Media Lynch Law is dangerous, not just to the famous, but to all who believe in common law principles.
